BELEAGUERED residents of the Brambles Estate in Whitchurch have demanded answers from council chiefs.

The Sherwood Homes development off Chester Road remains incomplete with problems over drainage and sewage in the street, as well as an unfinished road surface.

It has left residents to pursue their issues with Shropshire Council with the option of taking legal action against either the developer or the unitary authority for not checking if the work had been completed.

In a email to Clive Wright, chief executive of Shropshire Council, residents said they had receive no updates and demanded a meeting to discuss the site.

They said: “It is confusing as to what the delays appear to be.

“We have had meetings, communications and false promises given to us for a considerable amount of time now only to be let down again by your agents.

“Indeed, you have stated to the local press you are working with us and there is light at the end of the tunnel.

“This appears to imply you have some positive news; if so, can you share this with us.”

North Shropshire MP Owen Paterson has now told them the council can take action.

Jake Berry MP – minister for the Northern Powerhouse and Local Growth – told Mr Paterson that while he could not comment on specific cases, a planning authority could take action.

He said: “Where a local planning authority considers that development has not been carried out in accordance with the planning permission granted they can, if they consider it appropriate, take enforcement action.

“For example, they could serve an enforcement notice requiring the developer to remedy the breach of planning control. Failure to comply with such a notice is punishable on conviction by an unlimited fine.

“Where an enforcement notice is not complied with, local authorities have default powers to enter and carry out the requirements of the notice themselves.”

He continued: “Where something goes wrong, housebuilders and warranty providers should fulfil their obligations to put this right.”

Mr Paterson told homeowners that he would now be writing to the leader of the council, Cllr Peter Nutting, and Mr Wright, for further clarification on their plans for the Brambles.Residents have long urged action from Shropshire Council to complete the development, with issues including sewage spreading into bathrooms and gardens.

They believe that Shropshire Council should pay for the work towards the repairs though residents have stated the council have refused to do this.

Shirehall has also stated that they are not in a position to stop the developers from building in the authority again, despite the complaints about their work.

Shropshire Council declined to comment.
